Where a preliminary complaint is filed and properly signed, but the officer before whom the oath is taken fails to sign the same or affix his seal thereto, and an information is afterwards filed in the district court, and neither a demurrer nor motion to quash is filed, defendant will be deemed to have waived any defect in the preliminary complaint.
