(Syllabus.)
1. Witnesses — Disqualification of Physician or Surgeon to Testify as to Information Acquired Through Examination of Patient. Under the terms of Oklahoma Statutes 1931, section 272, O. S. Ann. title 12, sec. 385, a physician or surgeon is disqualified to testify as to information acquired by him through observation or examination of his patient. The wisdom of such a law is addressed to the legislative branch of the government, and not to the judiciary.
2. Same — Rule Applicable to Attendant Nurses.
3. Appeal and Error — Burden on Appellant to Show Prejudicial Error. Two things must be shown by an appellant in a criminal case before a conviction will be reversed, viz., that error was committed during the trial and that this error, unless jurisdictional, deprived the appellant of some substantial right, to his material injury.
4. Same — Permitting Physician and Nurse to Testify to Intoxicated Condition of Motorist Prosecuted for Homicide Held Prejudicial Error. Record examined, and found that the permitting of incompetent witnesses to testify was prejudicial and deprived defendant of a substantial right, to his material injury.
