(Syllabus.)
1. Searches and Seizures — Defendant's Statement to Officer "Look It Over and See" Was not Waiver of Search Warrant for Search of Car. The fact that the defendant stated to an officer, "look it over and see," was not such a statement as constituted a waiver of one's right not to have officer search his automobile without a search warrant, when the officer had already opened the door and searched the front part of the automobile; and had taken therefrom the keys for the purpose of unlocking the turtle back of the car, and stated to the defendant that he was going to do so.
2. Same — Search of Car Without Search Warrant Illegal Unless Offense Committed in Presence of Officer. "The search of an automobile by officers because of a suspicion that liquor is stored therein is illegal unless the officers procure a search warrant, or an offense is being committed in the presence of the officers that would justify the arrest of the possessor of the automobile."
