(Syllabus.)
1. Appeal and Error — Trial — Discretion of Trial Court as to Granting Severance in Misdemeanor Cases. Where one is charged jointly with another with the commission of a misdemeanor, the granting of a severance is within the sound discretion of the trial court. The refusal to grant the severance is reviewable on appeal, but the same will not be held error unless there was an abuse of discretion.
2. Intoxicating Liquors — Unlawful Possession — Receipts for Rent, Orders for Liquor and Other Bills Properly Admitted in Evidence. Where it is contended that certain exhibits offered in evidence were incompetent, record examined and found that court did not err in admitting the same.
3. Same — Retail Liquor Dealer's Tax Receipt Admissible Though It Had Expired Months Before Search. The introduction in evidence of the federal retail liquor dealer stamp found on the premises operated by defendant was properly admitted under the facts in this case.
4. Trial — Permitting County Attorney to Withdraw Certain Exhibits Which Had not Been Read to Jury Was not Error. Permission of the court to withdraw from the consideration of the jury certain exhibits which had been offered in evidence, but which had not been read to the jury, and where the court instructed the jury not to consider the same, was not error.
