Guy Martin, Appellant, v. Equitable. Life Assurance Society of United States, Appellee.

BROKERS, § 118.1 — when error to direct verdict for defendant in action for commission. In action by real estate broker to recover commission, alleged to be due him for services performed by him for defendant in sale of farm, held that prima facie proof of plaintiff's alleged cause of action appeared in record, and that, therefore, trial court committed prejudicial and reversible error in granting defendant's motion for directed verdict and in entering thereon judgment in bar of action and for costs at close of plaintiff's evidence.
