(Syllabus.)
1. Intoxicating Liquors — Question of Sale Only Issue in Prosecution for Sale. Where one is charged with the sale of intoxicating liquor to an individual, the question of the sale is the only issue involved in the trial of the case.
2. Same — Improper Cross-Examination of Defendant as to Reputation of Premises. Where the evidence revealed that one had sold whisky to individuals near certain premises, it was error to permit the county attorney to cross-examine the defendant with reference to the reputation of the premises, and of the owners thereof, where no evidence was introduced to in any way prove defendant's connection with the premises, or the parties owning or managing the same.
3. Same — Necessary Predicate for Evidence of Reputation of Premises. Where one is charged with the violation of the prohibitory liquor laws, before the general reputation of a place operated by him may be proven, it must be shown that such place was one of public resort, not merely that it bore such reputation.
