(Syllabus.)
1. Evidence — Lost Records — Admissibility of Docket of Deceased Justice of the Peace Showing Issuance and Return of Search Warrant. Where a search warrant has been issued by a justice of the peace after filing of a proper affidavit, and the justice of the peace has died prior to the date of trial, and another has been appointed, it is proper to admit in evidence the docket showing the issuance of the search warrant and its return, where it is shown that the original search warrant has been lost.
2. Arrest — Arrest and Search Without Warrant Where Offense Committed in Officer's Presence. Where officers have entered premises by reason of a valid search warrant, one committing a misdemeanor in their presence may be arrested without the necessity of a warrant. And after his arrest, it is proper to search his person and immediate premises.
3. Searches and Seizures — Halls and Stairways of Office or Apartment Building in Possession of Landlord for Use of Tenants. Common halls and stairways of buildings which are rented for offices or tenements are in possession of the landlord for the use of his tenants. The hall may or may not be a public place, as the facts justify.
4. Same — Room Rented for Storage not Necessarily Part of Home. Where one rents a room separate and apart from his living quarters, exclusively for the purpose of storage, it is not necessarily a part of his home.
