(Syllabus.)
1. Searches and Seizures — Sufficiency of Facts Stated in Affidavit for Search Warrant. An affidavit for the procurement of a search warrant should not be based upon information and belief, but should state facts upon which the same is based; but when facts are stated in the affidavit, and the same are positive, and by one who has a right to know the facts, it is sufficient ground for the magistrate to issue the warrant.
2. Trial — Court's Duty to Refrain From Remarks That Might Suggest to Jury That Court Had Opinion as to Guilt of Defendant. The trial court should be very careful to refrain from saying anything, or asking questions of witnesses, or suggesting to the county attorney how he should proceed, by which he might convey to the jury the impression that the court had an opinion as to the guilt or innocence of the defendant or the credibility of the witness.
3. Same — Appeal and Error — Review of Record to Determine Whether Court's Conduct Was Prejudicial to Defendant. Where it is contended that the trial court continually asked questions of witnesses, and made suggestions as to the manner of procedure by the county attorney, the entire record will be considered to determine whether the conduct of the court was so improper as to prevent the accused from having a fair trial, and in so considering the entire record the court will consider whether justice demands that the judgment and sentence should be modified.
4. Same — Punishment for Unlawful Possession of Liquor Reduced. Record examined, and judgment and sentence modified from a fine of $500 and 90 days in jail to a fine of $250 and 45 days in jail.
