(Syllabus.)
1. Automobiles — Evidence Admissible as Part of Res Gestae. Where one who witnessed an accident takes the license number of the automobile involved; and a party in the car immediately following the one involved in the accident also writes down the license number and hands it to the driver who follows the automobile and never loses sight of the same, the evidence of such license number is admissible as part of the res gestae.
2. Evidence — Sufficiency of Evidence to Sustain Verdict of Jury. Where there is a conflict in the evidence the verdict of the jury will not be set aside if there is substantive evidence to support it. It is only when the evidence is insufficient to sustain the judgment and sentence that relief will be given.
3. Appeal and Error — Case not Reversed Where all Instructions Properly Presented the Issues and Defendant not Prejudiced by Those Given. The instructions as a whole will be examined. An instruction which may be improperly worded will not necessarily cause a reversal of the case where all instructions properly presented the issues, and the defendant was not prejudiced by the instructions given.
