INSURANCE, § 4 — when recovery of rebated insurance commissions of agent was warranted. On appeal in action to recover portion of insurance agent's commissions which were rebated to defendant, the insured, where defendant contended that he was licensed insurance agent and that transaction was not rebate but merely sharing of commission between two licensed agents, and it appeared that defendant did not successfully carry burden of proving that he was licensed insurance agent, held that judgment for plaintiff was properly entered.
