(Syllabus.)
1. Trial — Instruction as to Burden on Defendant to Prove Innocence Approved. Instruction contended to be erroneous as casting burden of proof upon defendant to prove his innocence examined and approved.
2. Homicide — Burden of Mitigation on Accused.
22 O.S. 1941 22-745
"Upon a trial for murder, the commission of the homicide by the defendant being proven, the burden of proving circumstances of mitigation, or that justify or excuse it, devolves upon him, unless the proof on the part of the prosecution tends to show that the crime committed only amounts to manslaughter, or that the defendant was justifiable or excusable."
3. Homicide — Murder — When Prima Facie Case of Murder Established. Under Oklahoma Statutes (Tit.
22 O. S. 1941 § 745) a prima facie case of murder is established when the state proves, (a) the death of the deceased; and (b) that he was killed by the defendant.
4. Same — Sufficiency of Evidence — Prima Facie Case of Murder. If the two facts, death of deceased and that he was killed by the defendant, are proved beyond a reasonable doubt and without disclosing facts sufficient to raise a reasonable doubt as to whether the homicide was only manslaughter or as to whether it was justifiable or excusable, then prima facie the defendant is proved guilty of murder.
5. Homicide — Record Does Not Justify Reversal Because of Improper Argument of County Attorney. Record examined, and nothing found therein that would justify a reversal of this case by reason of improper argument of the county attorney.
6. Same — Modification of Sentence Not Justified. From an examination of the record, justice does not demand a modification of the judgment and sentence given in this case.
