(Syllabus.)
1. Appeal and Error — Waiver of Right to Have Conviction Reviewed by Appellant Leaving State Without Proper Permission. Where defendant after perfecting appeal, without permission or proper order of court first obtained, left jurisdiction of the court, voluntarily violating one of the conditions of supersedeas bond, defendant "waived" right to have judgment of conviction superseded and was in the attitude of a "fugitive from justice" and thereby waived the right to have conviction reviewed, and whether conviction should be reviewed became a matter for discretion of Criminal Court of Appeals.
2. Same — Dismissal of Appeal Where Appellant Beyond Jurisdiction of Court. Where accused was convicted for the unlawful possession of intoxicating liquor and during the pendency of appeal, left state without permission of court, was charged in another state with crime of forgery in second degree, convicted and sentenced to the penitentiary, his appeal will be dismissed.
