(Syllabus.)
1. Judgment — Order Nunc Pro Tunc to Correct Entry of Order Previously Made. The general rule with reference to the entering of an order nunc pro tunc is that it is an order to correct the entry of an order previously made not speaking the truth as to what was actually done or to make a record of what was previously done by the court, and not then entered.
2. Same — Rule Observed Where Result Will Effect or Perfect Entry as Legal Duty to Prevent Injustice. The above rule has special reference where the result will be to effect or perfect an entry which should have been made as a matter of course and as a legal duty to prevent injustice.
3. Motions — Application for Nunc Pro Tunc Order not Barred by Limitation Statute. An application for a nunc pro tunc order is not barred by the statute of limitations, where no intervening rights have been affected.
4. Judgment — Collateral Attack. Where the same court in which the original judgment and sentence was entered, enters a nunc pro tunc order correcting the original judgment, and a hearing is had thereon, evidence taken and both parties are present, the order so entered and unappealed from is conclusive upon the appellate court, and is not open to collateral attack, on the ground that the order was not made upon sufficient evidence.
