John N. La Belle, Appellee, v. Virginia Hillsman and Otto Hillsman, Appellants.

AUTOMOBILES AND MOTOR VEHICLES, § 143.7 — when collision judgment for plaintiff notwithstanding verdict for defendant is error. In action by plaintiff for damages to his automobile, as result of collision in city street intersection with defendant's automobile, wherein defendant filed counterclaim for damages to his automobile, and court sustained motion by plaintiff to vacate and set aside verdict and judgment entered in favor of defendant on his counterclaim, held that court was wholly unwarranted, in view of conflicting testimony as to negligence, in sustaining plaintiff's motion for judgment notwithstanding verdict, question of right of recovery being question for jury.
