STELLA K. LUSSEN v. IDA NASH

The statute making the owner or keeper of a dog liable for any damage to person or property done by it (§ 1380c, Cum. Sup. 1935) is controlled by the three-year Statute of Limitation for an action founded upon a tort (§ 1677c).

QUINLAN, J.

The demurrer is a little vague because it refers to a "statute in such case made and provided," presumably intending to mean the statute under which the action was brought; this notwithstanding no statute is referred to in the complaint.
