1. Habeas Corpus — Writ not to Be Substituted for Appeal. The writ of habeas corpus may not be substituted for an appeal.
2. Same — Evidence Resulting in Conviction not Considered in Habeas Corpus Proceeding Unless Bearing on Trial Court's Lack of Jurisdiction. In habeas corpus proceedings for release from State Penitentiary, evidence at trial resulting in conviction on which petitioner was sentenced will not be considered, unless it bears on question of trial court's lack of jurisdiction.
3. Same — Court Will not Entertain Application for Writ Based on Grounds or Facts Existing or Presented When Former Application Was Denied. Where the Criminal Court of Appeals has been denied application for habeas corpus, it will not ordinarily entertain a subsequent application for such writ on same grounds or facts existing when first application was made.
