(Syllabus.)
1. Evidence — Testimony of Officer as to Defendant's Being in Liquor Business Held Inadmissible. Where a defendant was charged soliciting the sale of intoxicating liquor by advertising, it was error to permit an officer to testify that he knew defendant and his occupation, and that he was "in the liquor business."
2. Same — Character of Defendant Cannot Be Impeached Unless Put in Issue, By Introducing Evidence of Good Character. It is a fundamental principle of criminal law that the character of a defendant cannot be impeached or attacked by the state unless he puts his character in issue by introducing evidence of good character.
3. Same — Hearsay Evidence Inadmissible.
4. Trial — Appeal and Error — Mandatory Duty of Trial Court to Declare Mistrial Because of Improper Argument by Prosecution. Where accused elected not to testify and attorney for the state in closing argument commented on such failure, it was mandatory duty of trial court, when matter properly called to its attention, to declare a mistrial and refusal to do so was reversible error.
