(Syllabus.)
1. Syllabus Followed in Roberts v. State, 87 Okla. Cr. 93, 194 P.2d 219. This is a companion case of that of Roberts v. State, 87 Okla. Cr. 93, 194 P.2d 219, decided by this court on March 10, 1948. The syllabus of that case applies to the facts here presented.
2. Continuance — Granting of Continuance Within Sound Discretion of Court. The granting of a continuance is within the sound discretion of the trial court, and the same will not be set aside unless there is an abuse of this discretion.
3. Rape — Evidence Justified Conclusion Defendant and Prosecutrix Were not Man and Wife. In a prosecution for rape, the fact that the defendant and prosecutrix were not man and wife may be proved by circumstantial evidence. Record examined, and found to justify the conclusion that defendant and prosecutrix were not man and wife.
4. Jury — Juror Excused in Companion Case not Justification for Challenge for Cause as Matter of Law. The fact that a juror called to serve has been examined for jury service and excused in a companion case does not justify a challenge for cause as a matter of law.
