Rosalie Bloom, Appellant, v. Ir

FORCIBLE ENTRY AND DETAINER, § 73 — sufficiency of evidence. Uncontroverted evidence that plaintiff was owner of two-story apartment building by gift from her parents prior to institution of forcible detainer action for possession of second-floor apartment, that plaintiff had been married for two years and had resided in building with her parents, and that plaintiff wanted apartment as living quarters for herself and husband necessitated conclusion that plaintiff acted in "good faith" in bringing action, as against defendant's arguments, unsupported by evidence, that conveyance to plaintiff was made to circumvent rent regulations; hence verdict for defendant on question of plaintiff's good faith could not be sustained.
