(Syllabus.)
1. Punishment — Request That Jury Assess Punishment Must Come Before Verdict Is Returned. Where the jury has returned its verdict of guilty into court, including in said verdict the statement that the punishment cannot be agreed upon, and such verdict is announced in open court, it is then too late for the defendant to request that the jury assess the punishment.
2. Habeas Corpus — Jurisdiction Limited to Determination Whether Judgment and Sentence Void. In original habeas corpus proceeding to secure release from penitentiary, Criminal Court of Appeals is limited to an examination of the record to determine whether judgment and sentence under which inmate is serving is void.
3. Same — Writ Cannot Be Substituted for Appeal. A writ of habeas corpus cannot be used to perform the office of a writ of error on appeal, but will be limited to cases in which judgment and sentence attacked is clearly void.
