ROXIE NAZARIAN, Respondent, v. NAZAR NAZARIAN, Appellant.

The papers handed up on the argument of this appeal, together with the record in this case, indicate need for reviewing appellant's financial position and making proper provision for his various dependents in accordance with their rights and needs and his ability to pay. As the order appealed from has been superseded by an alimony order of the Supreme Court in an annulment action (" Varney" v. " Varney", 178 Misc. 165), except for arrears due under the order appealed from up to the effective date of the Supreme Court order, the review of appellant's situation should be had in the two Supreme Court actions called to our attention on the argument. We affirm the order appealed from as to arrears, and otherwise refrain from passing on it as it is academic.
