In a proceeding pursuant to article 78 of the Civil Practice Act, appellants appeal from an order annulling the action of appellant board of education of the city of New Rochelle in abolishing certain positions which had been held by the petitioners, creating other positions in their stead and placing them in the classified service (see Civil Service Law, § 9), and appointing petitioners to such newly created positions; annulling the action of the appellant members of the municipal civil service commission in classifying the newly created positions as competitive; and directing the appellant board to reinstate the petitioners to their former positions. Order reversed on the law and the facts, without costs, and petition dismissed, without costs. The appellant board had the power to abolish the positions which had been held by the petitioners. The prescribed duties of the newly created positions do not, in our opinion, include any work which may be said to be pedagogic in nature. The findings of fact and conclusions of law are reversed and new findings and conclusions will be made. Carswell, Acting P.J., Johnston, Sneed, Wenzel and MacCrate, JJ., concur. Settle order on notice.
