EVELYN WEXLER, Doing Business under the Name of AUSTIN EMPLOYMENT AGENCY, Appellant, v. MRS. ALEX VEERMAN, Respondent.

Action to recover the amount of an employment agency fee earned in furnishing domestics to defendant. Order of the Appellate Term, affirming a judgment for defendant rendered at the Municipal Court of the City of New York, Borough of Queens, Small Claims Part, and the judgment of the Municipal Court, reversed on the law, and judgment directed for appellant in the sum of $10.80, with costs in all courts. It appears without dispute that an original domestic and a replacement, each furnished by plaintiff at the request of defendant, were hired or accepted by the latter and remained in her service for one week. Irrespective of the claim by defendant that their work was unsatisfactory the services of plaintiff had been rendered by the furnishing of the domestics, who were accepted and employed by defendant. The plaintiff's services were therefore compensable, within the limits of sections 185 Gen. Bus. and 186 Gen. Bus. of the General Business Law. Nolan, P.J., Carswell, Johnston, Adel and Sneed, JJ., concur.
