Jurisdiction has not yet been acquired in this court of the proceeding brought under article 78 of the Civil Practice Act dismissed at Special Term No order has been entered at Special Term and no notice of appeal served. The court, therefore, is without power to consider, and does not now consider, the purported appeal upon which the argument has been had. Bergan, P.J., Coon, Gibson, Herlihy and Taylor, JJ., concur.
