Case held, decision reserved, matter remitted to Niagara County Court for proceedings in accordance with the following Memorandum: On a preliminary hearing held on December 2, 1965 in accordance with the directions of People v. Huntley ( 15 N.Y.2d 72) to determine the issue of voluntariness of confessions allegedly made by defendant, the Trial Judge in finding that such confessions were voluntarily given failed to determine whether voluntariness was proved beyond a reasonable doubt. We return the case to the County Court solely for a determination of the issue of voluntariness as presented at the preliminary hearing for an appropriate decision under People v. Huntley ( supra). There need be no rehearing. The decision shall be made upon the testimony presented at the preliminary hearing. The Trial Judge's decision shall contain specific findings of fact and conclusions of law, and if the Judge finds voluntariness he must determine and decide whether it was proved beyond a reasonable doubt ( People v. Huntley, supra, p. 78; People v. Veitch, 25 A.D.2d 494).
