MARTIN, Bankruptcy Judge
A bankruptcy trustee had a security interest in crops under Section 70c of the Bankruptcy Act because the secured creditor's security agreement with the bankrupts and financing statement failed to specifically identify that section of land on which the crops were grown.
The bankrupts granted a security interest in all crops growing or to be grown within one year on the "farm in sections 26, 28 and 33 T2N, R8E in Green County, State of Wisconsin." A financing agreement containing the same legal description was filed. The bankrupts leased no land in section 26. The farmhouse and main buildings leased by the bankrupts were located in section 34. The trustee claimed that because the description of real estate on which crops were grown was inaccurate, the entire security agreement was unperfected and unenforceable against the trustee.
Wisconsin Statutes § 409.402(1)(b) provides that "when a financing statement covers crops growing or to be grown, the statement must also contain a description of the real estate concerned." Wisconsin Statutes § 409.110 provides that: "[f]or the purposes of this chapter any description of personal property or real estate is sufficient whether or not it is specific if it reasonably identifies what is described."
While comments of the drafters to the 1973 revision and from the official comments to the Uniform Commercial Code indicate that the present § 409.402(1)(b) was not intended to require a complete legal description on a financing statement in order to perfect a security interest in crops, a problem is presented where, as here the secured party elects to employ a reasonably specific description including section numbers. The secured party is not permitted to claim that crops grown on sections other than those listed are subject to its security interest. The public must be able to rely on the official U. C. C. records to determine whether the property of a debtor is subject to a prior security interest. For these reasons, the trustee, under Section 70c, has a security interest in crops grown or to be grown on section 34 which is prior to that of the secured creditor. The claim of the creditor is unsecured as to any crops grown on section 34. See Section 70c [§ 541(e)] at ¶ 9512.
