CALOGERO, C.J., would grant and deny intervenor's recovery against plaintiff-relator. The pleadings of the intervenor do not seek judgment against plaintiff, but rather unsuccessfully sought recovery from defendants out of such moneys as plaintiff might recover in the litigation from defendants, an event that did not come about.
WATSON and WILLIAMS, JJ., would grant the writ.
