The class consists of all North Dakotans or their legal representatives who, on or after December 1, 1989, were or are still, covered by a long term nursing care policy (Forms 520, 521 and/or 522) originally issued during the years 1984 through 1990 by Acceleration Life Insurance Company and later assumed by Commonwealth Life Insurance Company, but excluding from such class the defendants, any and all officers, directors, employees, and agents of the defendants, their affiliates, and/or subsidiaries.
