1. Evidence — Motion to Suppress Evidence Obtained by Search Warrant — Right to Introduce Evidence in Support of Motion. Where a motion to suppress the evidence challenging the validity of a search warrant is filed in proper time, the party filing the same has the right to introduce evidence in support of the motion. The refusal of the court to permit the introduction of evidence constitutes reversible error.
2. Intoxicating Liquors — Unlawful Possession — Question of Intent One of Fact for Jury Requiring Proper Instruction. Where one is charged with the unlawful possession of intoxicating liquor, it is error for the court to instruct the jury that possession alone is sufficient to convict the defendant. It is necessary to further charge that there was an intent on the part of defendant to violate the prohibitory liquor laws. The question of intent is one of fact for the consideration of the jury.
