ORDERED that the order is reversed insofar as appealed from, on the law, with costs, the motion is denied, and the complaint is dismissed.
"A party seeking to restore a case to the trial calendar after it as been dismissed pursuant to CPLR 3404 must demonstrate the merits of the case, a reasonable excuse for the delay, the absence of the intent to abandon the matter, and lack of prejudice to the nonmoving party" (Civello v. Grossman, 192 A.D.2d 636 ; see, Rivers v. Jamaica Water Supply Co., 250 A.D.2d 661 ). All of the above requirements must be satisfied before a case can be properly restored (see, Fico v. Health Ins. Plan of Greater N.Y., 248 A.D.2d 432 ). The plaintiff failed to meet her burden.
