On order of the Court, the parties having filed a stipulation to dismiss, we DISMISS the application for leave to appeal and we VACATE our order of September 29, 1999. The grant of the dismissal should not necessarily be construed as an endorsement of the Court of Appeals construction of MCL 440.2861(1); MSA 19.2A211(1). The motion to vacate is DENIED.
