(Syllabus.)
1. Continuance — Right to Continuance Where Defendant or His Counsel Is Member of Legislature in Session. Under Oklahoma Statutes 1931, section 396, Okla. St. Ann., Tit. 12, sec. 667, where the defendant or his attorney of record is a member of the Legislature or the Senate, and where such Legislature is in session at the time of the trial, and the defendant or his counsel is in attendance upon such session of the Legislature, the defendant is entitled, as a matter of law, to have said cause continued.
2. Same — Refusal of Continuance Held Error Under Showing Made. Where the motion to continue was presented and testimony taken upon the hearing of said motion, and the uncontradicted testimony revealed that the attorney who was a member of the Legislature had been employed and paid for his services long prior to the convening of the Legislature, and was in attendance on its sessions at the time that the motion for continuance was presented, it was error to overrule said motion.
