FRANKLIN WATER, Judge.
On this 7th day of August, 2000, came on for consideration the defendant's motion to stay proceedings to enforce judgment and authorize security other than by supersedeas bond. Specifically, defendants ask the court to stay the order of sale entered on June 19, 2000.
The United States has responded indicating it will not object to a stay of the order of sale so long as the following conditions are met: (1) that the defendants be directed not to alienate the property; (2) that the United States be allowed access to the property, for inspection purposes, on three days notice to defendants' counsel; (3) that proof of insurance should be furnished; and (4) that if the property is allowed to suffer waste, the insurance allowed to lapse, or defendants by act or inaction otherwise cause the diminishment of the value of the property that the stay should be ended. The United States does object to any stay of the monetary judgment against Jack Jepsen.
After receiving the United States response, the court asked defendants to file a reply brief. The court has now received the reply brief. Defendants state they will agree to the conditions suggested by the United States. Defendants, however, ask that the United States consider allowing the property to be leased. Finally, the defendants concede that an order staying enforcement of the monetary judgment against Jack Jepsen would be inconsistent with the appeal taken by them.
Accordingly, the sale of the property at issue in this case, referred to as the Mallard Point Property is hereby stayed. Further, the direction that all persons occupying the property vacate the property is also stayed.
The stay shall remain in effect during the pendency of the appeal provided the defendants comply with the following conditions:
(1) Defendants shall not alienate the property or any interest in the same;
(2) The United States shall be allowed access to the property, for inspection purposes, on three days notice to defendants' counsel;
(3) Proof of insurance, in an amount adequate to ensure the full value of the home, should be finished; and
(4) If the property is allowed to suffer waste, the insurance allowed to lapse, or defendants by act or inaction otherwise cause the diminishment of the value of the property this stay shall be ended.
The court will not order the United States to consider leasing the property. However, the United States may consent to such a lease on whatever terms it deems satisfactory to it including compliance with all terms of this order including the United States' right to inspect the property.
Enforcement of the monetary judgment against Jack Jepsen is not stayed.
IT IS SO ORDERED.
