JENNIFER KIMBLEY, Plaintiff, vs. LAWRENCE COUNTY, INDIANA, Defendant.

ORDER TO SHOW CAUSE

SARAH EVANS BARKER, Chief Judge.

Plaintiff, Jennifer Kimbley, filed a request for injunctive relief this week, pursuant to Federal Rule of Civil Procedure 65(a) (preliminary injunction) and 65(b) (temporary restraining order), seeking to prevent Defendant, Lawrence County, Indiana, from erecting and maintaining a monument containing the Ten Commandments on the Lawrence County Courthouse lawn. According to Plaintiff's filings, the monument at issue is the same structure we have already enjoined from being placed on the Indiana statehouse grounds. See Indiana Civil Liberties Union v. O'Bannon, No. IP 00-0811-C-B/S, 110 F. Supp.2d 842 (S.D.Ind. 2000). Before we had an opportunity to address Plaintiff's motions, and after Lawrence County clearly had notice that the monument had been prohibited and that this new action was pending before this court, the County hurriedly erected said monument on the courthouse lawn.

We hereby ORDER both parties to SHOW CAUSE why this Court's prior ruling in Indiana Civil Liberties Union v. O'Bannon is not dispositive of the issues involved in this litigation, why the County should not be held in contempt for violation of our prior ruling, and why the monument should not be removed forthwith from the County Courthouse lawn. Given the public interest in an expeditious resolution of these issues, both parties are hereby ordered to respond to these issues in written submissions no later than Monday, November 6, 2000, and to appear for an evidentiary hearing at 2:00 p.m. on Monday, November 13, 2000, in Room 216, U.S. Courthouse, 46 East Ohio Street, Indianapolis, Indiana.

It is so ORDERED this day of November 2000.
