On order of the Court, the delayed application for leave to appeal from the June 9, 1999 decision of the Court of Appeals is considered and it is GRANTED, limited to the issue whether defendant's collateral challenge of earlier OUIL convictions — a challenge based on lack of counsel or of effective waiver of counsel — was timely where it was not made until after he had pled guilty of OUIL, third offense. The parties should address the applicability of People v Crawford, 417 Mich. 607 (1993), andPeople v Ingram, 439 Mich. 288 (1992).
Persons or groups interested in the determination of this question may move the court for permission to file briefs amicus curiae.
