This matter came to be heard on April 18, 2001 in the above-entitled case on the motion of Phenix Manufacturing, LLC (the "Debtor") for an Order Authorizing Post-Petition Financing Pursuant to Section 364(d) Secured by a Senior Lien and Superpriority Expense Claim (the "Motion"). Cooperatieve Centrale Raiffeisen-Boerenleenbank B.A., "Rabobank Nederland" ("Rabobank") filed an objection to the Motion.
Rabobank and the Debtor entered into a Stipulation and Agreement dated April 18, 2001 (the "Stipulation"), pursuant to which the Debtor and Rabobank agreed to certain post-petition financing from Rabobank in lieu of that set forth in the Motion pending the final hearing on the motion.
The Debtor and Rabobank having agreed that this Order may be entered pursuant to the terms of the Stipulation;
IT IS HEREBY ORDERED THAT:
The Debtor is hereby authorized and directed to enter into and perform all of its obligations under the Stipulation, the of the Stipulation being hereby approved.
