CHARLES R. BREYER, United States District Judge.
Petitioner, a prisoner at Pelican Bay State Prison, has filed a pro se petition for a "writ of mandate" commanding the Director of the California Department of Corrections ("CDC") "to abide and adhere to the prescribed law, rules and regulations set forth within [California Code of Regulations] title 15, article 8 § 3084.6(4)" pertaining to the processing of prisoner administrative appeals. Petitioner specifically seeks an order compelling the CDC to address his appeal immediately.
Petitioner's request must be dismissed because it is well-established that federal courts may not order state officials to conform their conduct with state law. See Pennhurst State School Hosp. v. Halderman, 465 U.S. 89, 97-121 (1984). In addition, federal district courts are without power to issue mandamus to direct state courts, state judicial officers, or other state officials in the performance of their duties. Cf. Demos v. U.S. District Court, 925 F.2d 1160, 1161-62 (9th Cir. 1991) (petition for a writ of mandamus to compel a state court or official to take or refrain from some action is frivolous as a matter of law); sing no filing in forma pauperis order); Newton v. Poindexter, 578 F. Supp. 277, 279 (C.D. Cal. 1984) (federal mandamus statute, 28 U.S.C. § 1361, has no application to state officers or employees). Petitioner's remedy lies in state court, not federal court.
For the foregoing reasons, the petition for a "writ of mandate" is DISMISSED.
The Clerk shall close the file and terminate all pending motions as moot.
