STIPULATION
Plaintiff Union Station Associates LLC, and defendant Puget Sound Energy, Inc., by and through their counsel of record, hereby stipulate and agree to the following:
1. On October 4, 2001, pursuant to the parties' Stipulation and Order Re: Withdrawal of Counsel and Stay of Proceedings, the Court entered an Order requiring Marten Brown Inc. to withdraw as counsel for plaintiff Union Station Associates LLC ("USA") on or before Monday, November 5, 2001. The Court also ordered the action be stayed for a period of 30 days to allow USA to retain new counsel to represent it.
2. Since the entry of the Court's Order, Marten Brown Inc. has conferred with counsel at other law firms regarding their possible representation of USA. Several law firms discovered that they could not represent USA due to conflicts arising from their current representation of Puget Sound Energy, Inc. ("PSE") in unrelated matters. One such law firm agreed to seek a waiver from PSE that would allow it to represent USA in this matter. PSE recently granted that waiver. However, attorneys from that law firm have not yet been able to confer with representatives of USA regarding its claims against PSE and the details of any possible representation.
3. The parties and their counsel believe that it is likely that such conference can occur within the next two weeks. They expect further that USA can reach agreement with new counsel within the next 21 days that would allow Marten Brown Inc. to withdraw as USA's counsel.
ORDER
Based on the foregoing stipulation, it is hereby ORDERED, ADJUDGED AND DECREED:
1. The deadline for Marten Brown Inc.'s withdrawal as counsel for USA shall be extended from November 5, 2001, to November 26, 2001.
2. This matter shall be stayed and all pending deadlines shall be extended for a period of 21 days.
