Arthur N. Votolato, U.S. Bankruptcy Judge.
Heard on October 11, 2001, on, inter alia, Allstate Insurance Company's Motion for a Protective Order, and based on the arguments and upon consideration, a protective order is GRANTED, as follows:
The Debtors are allowed to conduct limited, expedited discovery, only on the issue of eligibility under 11 U.S.C. § 109(e), and a hearing is scheduled on December 13, 2001, at 9:30 a.m., to estimate the amount of Allstate's claim to determine whether the Debtors may remain in Chapter 13. A Joint Pre-Trial Order should be filed by December 10, 2001. Not an issue at said hearing is the validity or final amount of Allstate's claim, but only this Court's preliminary estimate of the amount of the claim for eligibility purposes. Until the § 109(e) issue is resolved, discovery is limited accordingly.
