Bridgeport Music, Inc. v. Gangsta Boogie Music, et al.

ORDER

TODD J. CAMPBELL, United States District Judge

Pending before the Court is Defendants AOLTW's Motion (Docket No. 20). The Motion is DENIED.

The First Amended Complaint sufficiently complies with the particularity requirements of Fed.R.Civ.P. 9(b) for averments of fraud. The First Amended Complaint, for purposes of Fed.R.Civ.P. 12(e), also is not so vague and ambiguous that the Defendants cannot reasonably be required to frame a responsive pleading. This matter is more properly the subject of a discovery request. Accordingly, the Rule 9(b) and Rule 12(e) motions are DENIED.

The Clerk shall post this Order on the Court's website (http://tnmd.uscourts.gov/) under "Bridgeport Music: Selected Orders" with the designation "Order — Rules 9(b) and 12(e)" followed by the docket number and date.

IT IS SO ORDERED.
