MANDY S., by and through her mother and next friend SANDY F., Plaintiff, v. FULTON COUNTY SCHOOL DISTRICT, Defendant.

ORDER

G. ERNEST TIDWELL, UNITED STATES DISTRICT Judge

The above-styled matter is presently before the court on defendant's motion to publish judgment [docket no. 40].

Plaintiff filed this action seeking review of an adverse administrative decision pursuant to the Individuals With Disabilities Education Act ("IDEA"), 20 U.S.C. § 1400, et seq., and its implementing regulations, 34 C.F.R. § 300.1, et seq. On August 30, 2000, this court issued an order denying plaintiff's motion for summary judgment and granting defendant's motion for final judgment. Judgment was entered the same day. The Eleventh Circuit Court of Appeals affirmed the decision of the district court per curiam on September 5, 2001.

Defendant now moves this court to publish the August 30, 2000 judgment of the district court. Plaintiff objects on the ground that the request is untimely. Having read and considered the pleadings of the parties, this court finds no legal impediment to the publication of the judgment. Furthermore, the court has no objection to the publication of the judgment. Therefore, defendant's motion to publish judgment [docket no. 40] is GRANTED on the condition that the defendant is responsible for effectuating the actual publication of the judgment.

Summary

Defendant's motion to publish judgment [docket no. 40] is GRANTED on the condition that the defendant is responsible for effectuating the actual publication of the judgment.
