Richard Gillette, Mo v. nt,

ORDER

LEWIS A. KAPLAN, United States District Judge

Movant's motion for relief of judgement or order pursuant to Rule 60(b) [sic] is denied for the following reasons:

1. The motion in fact does not seek vacatur of the order denying movant's Section 2255 motion in order to have the issue raised thereby reconsidered but pursues entirely different relief based on entirely different facts. This is not a proper basis for a Rule 60(b) motion.

2. No basis for relief under Rule 60(b) has been shown.

3. Putting aside these procedural difficulties, the issue movant now seeks to raise is not cognizable under Section 2255.

4. In any case, there is no basis for the relief movant seeks.

SO ORDERED.
