Atlantic States Legal Foundation, Et Al. Plaintiffs, v. Onondaga County, Et Al., Defendants.

ORDER

HON. THOMAS J. McAVOY, U.S. District Judge

This order is prompted by the confusion of the parties regarding the procedure for joinder of a party to this litigation. The County of Onondaga ("County") seeks to join the City of Syracuse and the Syracuse Urban Renewal Agency in order to comply with the consent decree between the County and the Plaintiffs. Before this Court is a plethora of faxes and letters regarding the procedure for that joinder.

Therefore, in accordance with Fed.R.Civ.P. 19 and 21 and Local Rule 7.1(a)(4), and in the interest of justice and judicial economy, it is hereby

ORDERED:

1) that the County shall forthwith file its motion for joinder and serve it upon the City of Syracuse, the Syracuse Urban Renewal Agency, and the other parties to this action;

2) that the City of Syracuse and the Syracuse Urban Renewal Agency, and any other party opposed to such joinder, shall respond to such motion by raising only their objection to the motion for joinder and shall not raise in these papers any other defense or issue unrelated to joinder; and

3) that if the City of Syracuse, the Syracuse Urban Renewal Agency, or the other parties to this action do not intend to contest joinder, each shall submit a letter to the Court stating that position and such letter shall be filed with the Clerk by the date which opposition to the motion would otherwise be due.

IT IS SO ORDERED
