Before the Court are Defendant Columbia Medical Center at Lancaster's Motion to Dismiss, filed November 21, 2001; Defendant Baylor Medical Center's Motion to Dismiss, filed November 21, 2001; Defendant Parkland Memorial Hospital's Motion to Dismiss, filed November 14, 2001; Plaintiffs' Original Answer, filed December 4, 2001, which the Court construes as Plaintiffs' Response to the respective Motions to Dismiss; Defendant Parkland Memorial Hospital's Reply, filed December 13, 2001; Defendant Columbia Medical Center at Lancaster's Reply, filed December 27, 2001; Defendant Baylor Medical Center's Reply, filed December 27, 2001; and the Findings, Conclusions and Recommendations of United States Magistrate Judge, filed February 5, 2002. No objections have been filed.
The Court has made the required independent review of the pleadings, files, and records in this case and the Findings and Conclusions of the Magistrate Judge. Having done so, the Court is of the opinion that the Findings and Conclusions of the Magistrate Judge are correct and they are ADOPTED as the Findings and Conclusions of the Court. Defendant Columbia Medical Center at Lancaster's Motion to Dismiss is GRANTED; Defendant Baylor Medical Center's Motion to Dismiss is GRANTED; and Defendant Parkland Memorial Hospital's Motion to Dismiss is GRANTED.
