NOWAK, Judge
The matter before the Court is the status of this case. Defendant PI Construction Corporation filed an answer pro se, by and through its president and co-defendant William Clary.
Because a corporation is a fictional legal person, it can only be represented by a licensed attorney. Self-representation by unskilled persons usually leads to delay, confusion and other difficulties in the judicial system. When a corporation declines to hire counsel to represent it, the court may properly strike its defenses.
Donovan v. Road Rangers Country Junction, Inc ., 736 F.2d 1004, 1005 (5th Cir. 1984) (per curiam);
See e.g., Hawkeye Bank Trust v. Baugh , 463 N.W.2d 22, 24 (Iowa, 1990).
Top Sales, Inc. v. Designer Vans, Inc ., 1997 WL 786254, (N.D.Tex. 1997). See Donovan v. Road Rangers Country Junction , 736 F.2d at 1005 (holding district court properly struck defenses of corporate defendant who declined to hire counsel).
It is clear that defendant PI Construction is not permitted to litigate this case pro se. Accordingly, within 30 days of the date this order is filed, PI must retain counsel and cause counsel to enter a written appearance with the clerk of this court. If it fails to do so, its answer will be stricken without further prior notice, and the court will conduct further proceedings, including default judgment, as applicable, in accordance with law.
