Presently before the Panel is a motion, pursuant to Rule 7.4, R.P.J.P.M.L., 199 F.R.D. 425, 435-36 (2001), by plaintiffs in this action to vacate the Panel's order conditionally transferring the action to the District of Utah for inclusion in the Section 1407 proceedings established there in this docket. Defendants E.I. DuPont de Nemours and Company; Dyno Nobel Inc.; Mountain Explosives Company; ICI Explosives USA, Inc.; Orica USA, Inc.; and Sandy Valley Explosives Company, Inc. oppose the motion to vacate and favor transfer of the action to the District of Utah. On the basis of the papers filed and hearing session held, the Panel finds that the action involves common questions of fact with the actions in this litigation previously transferred to the District of Utah, and that transfer of the action to the District of Utah for inclusion in Section 1407 pretrial proceedings will serve the convenience of the parties and witnesses and promote the just and efficient conduct of the litigation. The Panel further finds that transfer of the action is appropriate for reasons expressed by the Panel in its original order directing centralization in this docket. The Panel held that the District of Utah was the proper Section 1407 forum for actions concerning an alleged conspiracy by the defendants to fix the prices of commercial explosives, which encompasses allegations that defendants conspired to impose various fictitious surcharges on their customers.
