MARSHA J. PECHMAN, United States District Judge
STIPULATION
On January 23, 2002, the Court entered its Order Setting Trial Date and Related Dates. Among other things, that Order established a deadline of June 12, 2002, for service of reports from expert witnesses and a deadline of August 12, 2002, for completion of discovery.
On May 10, 2002, the Court entered an Order upon the stipulation of the parties establishing additional deadlines for the disclosure of expert witnesses, while preserving the original June 12 date as a deadline for plaintiff's Fed.R.Civ.P. 26(a)(2) expert disclosures and for defendant's Rule 26(a)(2) disclosures related solely to issues on which defendant has the burden of proof
Although the parties have been pursuing discovery diligently, it has become apparent to them that certain discovery relevant to the preparation of expert reports, including discovery sought from third parties via subpoena, will not be completed in time for that discovery to be considered by their expert witnesses in advance of the current expert disclosure deadlines. The parties agree that the deadlines for expert disclosures should be extended by approximately thirty (30) days so as to allow additional time for completion of such discovery, recognizing that extension of those deadlines would also necessitate extension of all other deadlines which follow thereafter.
Therefore, the parties hereby jointly request that the Court extend by approximately thirty (30) days the pretrial deadlines currently set forth in the Court's Orders of January 23, 2002, and May 10, 2002, and stipulate to entry of the following amended scheduling Order. Such an extension will permit the parties to establish a more complete discovery record before expert witnesses are identified and Rule 26(a)(2) materials must be served and allow additional time for completion of expert depositions and all remaining discovery. The deadlines proposed below would permit completion of the pretrial process by the end of this year. The parties request that the trial be scheduled to commence on or after January 21, 2003.
