PER CURIAM:
Appellant Terry Edney appeals from the dismissal of a petition for post-conviction relief. The case is before the court on a sua sponte motion for summary disposition. We dismiss the appeal because we lack jurisdiction.
Failure to file a timely notice of appeal bars jurisdiction in the appellate court. See Reisbeck v. HCA Health Services, 2000 UT 48, ¶ 5,16, 2 P.3d 447. Because it is undisputed that Edney failed to file his notice of appeal within thirty days after the date of entry of the judgment, "this court may entertain [the] appeal only if the time for appeal was appropriately extended." Serrato v. Utah Transit Auth., 2000 UT App 299, ¶ 7, 13 P.3d 616. The time for filing a notice of appeal from the dismissal order, entered on December 17, 2001, expired on January 16, 2002. See Utah R. App. P. 4(a). That time was not extended by the State's failure to provide timely notice of the entry of judgment.See Utah R. Civ. P. 58A(d) (stating time for filing notice of appeal is not affected by requirement to give notice of entry of judgment). The time for filing a motion to extend the time for appeal expired on February 15, 2002. See Utah R. App. P. 4(e) (requiring motion to extend to be "filed not later than 30 days" after expiration of appeal time under rule 4(a)). The motion to extend was not filed until March 22, 2002. Accordingly, the motion was not properly before the district court and the time for appeal was not appropriately extended. This court has no alternative but to dismiss the appeal. See Varian-Eimac, Inc. v. Lamoreaux, 767 P.2d 569, 570 (Utah Ct.App. 1989) ("When a matter is outside the court's jurisdiction, it retains only the authority to dismiss the action.)."
We dismiss the appeal for lack of jurisdiction.
James Z. Davis, Judge, Pamela T. Greenwood, Judge, and Gregory K. Orme, Judge.
