SARAH S. VANCE, United States District Judge.
Before the Court is the motion of defendant, Danos Curole, for Leave and Incorporated Memorandum To File Cross-Claim. For the following reasons, the Court DENIES defendant's motion.
Three and a half months after this Court's deadline of April 26, 2002 for third-party action (thirty days after the preliminary conference), Danos Curole ("DC"), which was made a defendant on November 26, 2001, attempts to file this cross-claim against Vastar. The motion arrived one week before the. conference and two and one half weeks before trial. The deadline to conduct discovery was July 30, 2002, and the deadline for filing motions responding to cross-claims, such as a Motion for Summary Judgment, was July 9, 2002. Vastar would be prejudiced by the cross-claim because it would not have adequate time to conduct discovery prior to the pretrial conference and trial, nor could it now file a Motion for Summary Judgment on DC's cross-claim if it wished to do so.
The Court finds DC's only explanation for its tardiness — that it could not obtain the deposition of a Vastar supervisor until August 2, 2002 — to be insufficient grounds for granting its motion.
For the foregoing reasons, the Court hereby DENIES DC's motion for Leave and Incorporated Memorandum To File Cross-Claim.
