ORDER GRANTING LEAVE FOR THE NEZ PERCE TRIBE TO APPEAR AS AMICUS CURIAE ROBERT S. LASNIK, United States District Judge This matter comes before the Court on a motion filed by the Nez Perce Tribe (the "Tribe") for leave to appear as amicus curiae. The Tribe asserts that it has interests in the fish, wildlife, and cultural resources of the Snake River Basin, which may be affected by the actions subject to this proceeding. A "district court has broad discretion to appoint amici curiae." Hoptowit v. Ray, 682 F.2d 1237, 1260 (9th Cir. 1982). The Court finds that the Tribe's input in this action will be helpful as the Court considers Plaintiffs' motion for a preliminary injunction. Amicus curiae status therefore is appropriate. The Court GRANTS the Tribe's motion for leave to appear as amicus curiae. Defendants may submit a reply, not to exceed twenty pages, to the Tribe's memorandum in support of Plaintiffs' motion for preliminary injunction by December 6, 2002. The Clerk of the Court is directed to send copies of this Order to all counsel of record.
